Who Breached the Contract?

I am from makati. I have been a subscriber since May 2007.

1st month was great. I’m getting like fairly fast when i download mp3, videos and games. After that the service completely s#!%k. I get disconnected every hour and speed is like 15-29kbps. The worst I had was 2kbps(wth).

I wanted to get rid of the service but every time I asked everyone from customer hotline, they would say that I need to pay for the penalty since I’m locked for 1 year.

The service is 100% terrible. If you try to build the picture, it’s never been the subscriber’s fault. We were told that the service is like 10 times faster than dial-up but in reality, it’s worst than dial-up.

My question is — Shouldn’t be the governments job to catch businesses who mislead consumers? Where is the consumer welfare act now? Why are consumers being locked up on a contract and asked to pay a penalty when infact we are being mislead and betrayed? Or maybe someone from the government is enjoying a huge cut while the ppl are being milked by this greedy CEO.

I really wanted to get rid of the service but the big question is…. Who breached the contract? Is it the consumer who wants to discontinue the service before completing the contract or the greedy Smartbro who mislead and betrayed you at the very start? pls post your blog. I really appreciate it.

Call for a Class Action Lawuit

Guys, can’t we form a serious Class Action Lawsuit against this BIG SMARTBRO / WIFI SCAM?

I mean, instead of just posting our frustrations, we can open a dedicated thread to petition signatures for a CAL. We need to get a good lawyer.

This HELL must stop. We’ve been trapped in this for a year, and they also renew it automatically if it ends. Be sure to call them in advance that you don’t want to continue your subscription. One year is enough hell to deal with their crappy technical and customer support. And they have the nerve to sue if you don’t pay. Evil to the core.

Please, whoever is capable of opening a dedicated section for CAL, here or on some other website, do so. We need to act together. I’ve read stories of people forced to pay for SmartBro service that they didn’t receive. If we take on them one by one, we can’t do anything. We must take on them in full force and in the manner they play.

Can We Transfer to PLDT?

Since PLDT owns Smart, or it’s one of their sister companies, shouldn’t we be allowed to transfer to PLDT myDSL XPERIENCE if Smart Bro doesn’t work for us?

Just a suggestion, did anybody else try to ask this yet, I’ll ask this next time I go to a service center.

Don’t pay your next bill!

As subscriber, we must have documents signed prior to application of smartbro. sa tingin ko naman wala, meron ba sa inyo?

Di ba kayo nagtataka Smart Gold subcriber– they filter the applicants. baki kaya dito sa smartbro, hindi. basta process ka lang don sa cashier, wait for 2-3 days to have your internet connection.

Sa akin, the next day kabit agad….

Regarding the application…… sa tingin ko lang wala talagang formal agreement with this from smart to its subscriber…….. ano ba pinagkaiba na Smart Gold subscriber sa atin…. we are both postpaid subscriber of a certain service.

To cut it short….. wala habol ang smart kung di man tayo magbayad ng bill…

Tapos me new service offer ang ibang network…… cheaper pa at me phoneline….

Regarding don sa bill, Disconnection– states that at least one bill payment is missed. yeah! totoo, you’ll lost your connection after few days of your due date once you missed paying.

But to tell you guys, its very easy to reconfigure and get a new IP…… after few minutes you can continue your browsing…

Tapos isa pa guys….. this is a networking connection… thats why some of us shares the same IP. thats irony kasi as third world country… large% of the IP owned and assigned only to US and some countries… kaya patok ang networking…..

Basta….. once you are discontented with the service, don’t pay your bill… you’re just letting them fool you.

Ask me how to reconfigure your connection… and i will help you in anyway i can.

Just this afternoon, some customer representative from smartbro called me for the scheduling of visit of one of their contractors. It was very nauseating because the lady started raising her voice and kept telling me that sending their contractor by 5:30pm is a waste of time ( talk about courtesy ). They want to send the guy earlier than 5:30pm when in fact, my connection thoroughly cuts off at exactly the same time? How will they fix something which isn’t even showing the symptoms of a broken internet connection? I had been very patient with dealing with them but this time i’m not going to be nice. And in addition to all that, i was decieved by the technicians which installed my connection. They said that there are no connection fees which they included in my bill, No hidden charges when they hid the fact that there was a connection fee and told me that i could cancel my connection anytime i want for FREE! That was such a fat lie, considering the fact that i trusted them into providing that 24 hour service they promised. As for that customer representative, i’ll do something she’ll never forget. Something that suits those people who cause much damage in time, money, and effort. That’s an idea! Can we sue them for causing damages and pay us in return?

Termination of Subscription

Hey guys,

I talked to my friend na lawyer and she told me about the things concerning a contract. sa ngayon kasi, lumalabas na bound tayo ng contract with SMART kasi nga sinasabi nila na may one-year lock-in period tayo prior to availing their service.

Ganito kasi yung scenario natin. ang lumalabas it’s next to impossible to cut our subscription with them. pwede nilang palabasing breach of contract yun. pero, as subscribers, we have the right to have it terminated since they didn’t comply to their part of the contract. that is providing us with a great connection “up to 7x faster than dial-up” according to their ad. we call that RESCISSION. kaya if you guys would like to cut your subscription, yes, it is possible. at wag kayong magpatakot dun sa mga sinasabi nilang pre-termination fee. seek for legal advice rin para you have a back-up regarding this. as you know masyadong tuso ang SMART managament. if not, we won’t be experiencing all these.

Billing statements from Smart

Has anyone received billing statements from Smart? Or, has not received? Kindly post.

I’m currently in an ongoing email cha-cha with customercare regarding delivery of my billing statements. Since I signed up early this year, I have not received a single billing statement.

Why is this important? If people are looking to filing legal complaints against Smart for non-delivery of services, you’d have to prove that you’re a SmartBro subscriber. How? By presenting the billing statements and your corresponding payments.

Log your problems and get Service Call Number

Hi all,

In order for us to pressure SMART management to act on all our Disconnect problems, please log your calls by calling *1888 on your cp , 672 7277 on Manila landline or use Toll Free 1800-10-672 7277 when you are outside Manila and pls. don’t forget to get the SERVICE CALL NUMBER (SCN) from the tech support. Make a list for your selves, include, time/date of call and the SCN. This way SMART will have records of all our problems and top management will do something about this.

Then send a complaint letter to

    ntc@ntc.gov.ph

cc : customercare@smart.com.ph .

I’m already sick and tired of the disconnect problems I am encountering …if you can ping 192.168.224.1 and 10.0.0.1 but can’t ping 203.87.128.3 (DNS server) this is a SMART problem and not your unit, don’t waste your time in the t-shooting BS! Just inform tech support about the ping result and create a SCN.

Hope we can all wakeup to this internet service nightmare!
